I have been thinking, what makes me who I am today? Everything around. One TED talk speaker said, babies take statistics by listening to grown ups to develop speech. As grown ups, I think we too take statistics in many things. &lt;br /&gt;&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;I like reading a post on "&lt;a href="http://www.rockybru.com.my/"&gt;rocky's bru&lt;/a&gt;" about Anas Zubedy. But the ending made me frown. Thus, my silence is broken by a phrase (or maybe a pun) "&lt;a href="http://www.rockybru.com.my/2011/07/malaysians_06.html"&gt;that elusive Malaya and now Malaysia race&lt;/a&gt;". It is very subtle. Some sense of belonging may be teased by a phrase. Marina's scribbles "&lt;a href="http://rantingsbymm.blogspot.com/2010/03/column-that-wasnt.html"&gt;The Column That Wasn't&lt;/a&gt;" in her blog "Rantings byMM" caught my attention. Most of us shun away in silence as our fundamental liberties are scarce. &lt;br /&gt;&lt;br /&gt;Obviously, many of the citizens do not want to discuss about the syariah laws in Malaysia because one does not know that much and one fears. It doesn't help if (or when) these laws are not debated when they are tabled in Parliament. &lt;br /&gt;&lt;br /&gt;We still don't know what those law enforcers might do although they seem to enjoy the publicity. And the police too? Talk about power!? Look at this newspaper report:&lt;br /&gt;&lt;br /&gt;&lt;span style="font-style:italic;"&gt;&lt;blockquote&gt;The man will also be charged at the Syariah Court with cohabiting with the victim's mother to the extent of having a child born out of wedlock, said Hulu Selangor deputy police chief Deputy Superintendent Bakhtiar Rashid.&lt;br /&gt;&lt;br /&gt;He said said police would also be referring the suspect and the Syafia's mother to the Selangor Islamic Religious Council for further action.&lt;br /&gt;&lt;br /&gt;He said initial investigations found that the unmarried couple had known each other for six years.&lt;br /&gt;&lt;br /&gt;"The mother has not divorced her husband but yet is living like a married couple with the suspect." The people must have faith in the judicial system and not let their beliefs harrowed up by mere selfishness.&lt;br /&gt;&lt;br /&gt;The political movements in our country now see the idea of a unity lauded by the federal government and the state; one that I must highlight being from PAS president Datuk Seri Abdul Hadi Awang last year. Malaysians glorify many new years and at this moment, I am moved to scribble some words.&lt;br /&gt;&lt;br /&gt;We have seen many incidents recently, which might be some kind of provocative measures by some irresponsible individuals, just to make news. They might also intend to divert us from addressing the more important issues. Some of the issues that I can think of for now are:&lt;br /&gt;- to improve our economy by stopping the subsidies, or &lt;br /&gt;- to make the roads in Malaysia "pothole-less" all the time, or &lt;br /&gt;- to promote Carbon capture and storage (CCS) and alternative environmental friendly technologies&lt;br /&gt;- and more...&lt;br /&gt;&lt;br /&gt;I know the PM said People First and Performance Now, but I am not sure whether our PM has the means to deliver. His supporters, mainly the Cabinet, are not very proactive and this leads to non-accomplishment of the true meaning of that phrase. The politicians are too keen to get the people's support that they even make a big issue our of nothing. "That's why they are politicians!", many a remark made at coffee shops. I find that to be true especially when I read their many statements that make me go "Ah, come on la ___(name)! What is this?".&lt;br /&gt;&lt;br /&gt;Perhaps the people of Malaysia can move together to turn the politicians heads to look at more pressing issues. Today, after some hours of meeting people, I suddenly remembered some of my meetings with friends. &lt;br /&gt;&lt;br /&gt;Work, meeting, any activities and understanding make us a great team. I am also looking at it as a Malaysian. As in my previous post, I would like labels to be done away with. I also maintain my respect for the deeds that our previous politicians had done in the political parties and that brought us to have our own country called Malaysia.&lt;br /&gt;&lt;br /&gt;But I believe, we can make change for better. Why don't we start with the politicians who are calling for the 1Malaysia concept. Make political parties for Malaysians. Any person who is a citizen of Malaysia can choose to be a member of any political party. Persons of various heritage do not have to ascertain race or religion before qualifying for any party. Mix marriages is not uncommon in Malaysia or anywhere in the world. &lt;br /&gt;&lt;br /&gt;I'd like to understand the mumble jumble in the fights and arguments. But having raised in the way my family is, I can't understand why there seems to be hatred in the air based on what we believe in. Why are we sensitive and rebel especially when it involves heritage and belief?&lt;br /&gt;&lt;br /&gt;To feel Malaysian and celebrate it, why don't we ignore the labels. We would be able to discuss anything and look at the issues (raised by some people) in the wider sense.&lt;br /&gt;&lt;br /&gt;Put yourselves in the shoes of people like me, for example, with a family of many races and beliefs. Even when we like someone, look at the quality in the person. I've found many good people by doing that. And there are many good people in this world.&lt;br /&gt;&lt;br /&gt;The answers that the person puts in the forms don't matter. And we hear calls for the public to help. I am sure many of us would follow our conscience to help. But this has been the talk! &lt;br /&gt;&lt;br /&gt;Can we also please at least look at some other possible solutions? SMS notification to those detected to be in certain areas, on the number of crimes reported, for example.&lt;br /&gt;&lt;br /&gt;I had a discussion with a friend last night. I realised later, thanks to my friend, that I don't feel the presence of the police in most places. My understanding has been that the police force is established to protect. Many years ago, I used to see many policemen and policewomen in public places. &lt;br /&gt;&lt;br /&gt;Now, I don't feel their presence except for big events. How about the presence of the police in public areas or on public roads? Even when we have the "pondok polis" in some places, very seldom that we see the police. &lt;br /&gt;&lt;br /&gt;Having the police around is a comfort for the law abiding citizens. It is an indication that the protectors are around. Our PM, YAB Dato' Sri Najib seems to be trying to be unique in his own ways. Hopefully the trend of work will be up to standards, now that he has started to talk about the three letters; the K, the P and the I. Although I think he might have got the idea from the judiciary.&lt;br /&gt;&lt;br /&gt;Listening to all the talks about problems faced when dealing with the office of the previous PM, I am thinking of our new PM like maybe George Bush's son, carrying on a legacy. Well, maybe George Bush is not exactly the man. &lt;br /&gt;&lt;br /&gt;But THE WALKS? Why was that show put on? I am sure many of us would like something genuine from the first man. At least I hope that those were genuine. Hopefully we can all cheer for this Prime Minister.&lt;br /&gt;&lt;br /&gt;Dear Prime Minister, I really like that idea of less formality. But the election of representatives requires much more than time. Working for the people, that's the concept. Efforts are made for the good of all. Be reminded that it was the fight for independence that got us this country. These came to my mind when I heard someone talking about the cases that he handled at the hospital. How about that?&lt;/div&gt;&lt;p&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;And here I am, always wanting to go to any blood donation drive but the advertisements are scarce and difficult to locate. I thought that we should have one that we can refer to on the blood donation drive. It doesn't matter whether it is by the government hospitals or the private hospitals. The purpose is to save lives.&lt;/div&gt;&lt;p&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;Therefore, I am suggesting that there be a website by the Blood Bank, that assists the hospitals to advertise and the public to refer easily. Who should be approached to make it a reality? It's like chocolate... to me, at least.&lt;br /&gt;&lt;br /&gt;The judiciary is going to be showing some changes in performance and perhaps innovation. The Chief Justice seems to be working very closely hand in hand with the other judges.&lt;br /&gt;&lt;br /&gt;The most enticing is that seniority will be based on delivery and merits. Finally! But two Judges are monitoring the judges and judicial officers, whether they like it or not. How effective that will be? We'll have to see that and hopefully, soon.&lt;br /&gt;&lt;br /&gt;Whatever it may be, the CJ is indeed making a change. Karpal vs Reform?</title><content type='html'>It is obvious that the new Chief Justice, Tan Sri Zaki Tun Azmi, has done justice to all when he started the "no postponement" ideas in the Court of Appeal. Now that he is the Chief Justice, all the courts in Malaysia are applying the same for the purpose of reducing backlog. Reforming the judiciary has been his aim, based on his speech, he asked for the cooperation of all.&lt;br /&gt;&lt;br /&gt;Nearing the appointment in October 2008, the voices against the appointment finally said, "Give him a chance."&lt;br /&gt;&lt;br /&gt;It is realised that there are many unhappy lawyers out there and perhaps, the team of Karpal as well. It is not a new thing that this particular lawyer had always taken the opportunity to voice dissatisfaction on the outcome of his own cases in the Parliament. Well, this time, many of his cases are affected because of his busy schedule. Therefore, his attack this time is also seen to be personal.&lt;br /&gt;&lt;br /&gt;Backlog of cases has been seen by the public as being caused by the courts because the courts grant postponements. The general public does not know that in most cases, it is the lawyers who ask for postponements in court, in which the courts will have to decide whether to grant or not. And in some cases, when the courts refused to postpone, the lawyers start withdrawing from representing the clients, to "force" the courts to give the clients time to appoint other lawyers.&lt;br /&gt;&lt;br /&gt;The lawyers in most cases do not explain the reasons for postponements to their clients and straight away put as the court decided the postponement. So the blame to the courts continue in the minds of the laymen.&lt;br /&gt;&lt;br /&gt;So the fact remains that the politicians in the opposition were unhappy when the CJ was going to be appointed. Why? Because he was a lawyer and represented a party? But none commented negatively on the appointment of a judge Arif who was a lawyer and also actively represented a party. Evidently, the judges are not politicians.&lt;br /&gt;&lt;br /&gt;Now that the CJ has done many reforms, some of the lawyers are unhappy as they have to also think of a way to be "able and willing" in all the briefs. And the lawyers must help the courts to dispose of the cases without having to decide on their applications for postponements.&lt;br /&gt;&lt;br /&gt;The judiciary needs to focus on the new efforts to improve. For all you know, lawyers and parties will send or are sending feedbacks that their cases are disposed of much faster. The reform must continue. The law is not about mere allegations. And why is he not making a fuss about the advisors of other political parties that had been appointed to serve in the judiciary?&lt;br /&gt;&lt;br /&gt;Of course, in cases, there are parties who win and parties who lose. And you can also find some sore losers making allegations here and there including the blogs. But the decisions made by the judges are not without grounds and more often than not, those who are not satisfied with some decisions are given the opportunity to appeal.&lt;br /&gt;&lt;br /&gt;It is a pity that the public is not really told and explained about the judgments delivered by the judges. Or some of them are told as news of the day, but none really taken into account when passing remarks about the judiciary. Look at the judgments on the website of the judiciary and evaluate them yourselves. Try some of the &lt;a href="http://www.kehakiman.gov.my/judgment/fc/latest.shtml"&gt;latest judgments in the federal court&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;The Star further reported the politician Lim that "&lt;em&gt;He said that if Zaki becomes Chief Justice next week, the constitutional provision was likely to be invoked for a full parliamentary debate on a substantive motion into his suitability and qualification.&lt;/em&gt;" What is that? However, good judgments of the editors as well as the readers play big roles. &lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;p&gt;&lt;div align="justify"&gt;Being in Malaysia and being citizens of Malaysia, a privilege. A country which has been known for the smiles, understanding, tolerance and care of the people, took us to be known to the world. Tourism boosted our economy strength. That's the strength of our pleasant identity and friendliness. &lt;/div&gt;&lt;p&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;Let us not compare too much of our country with other big old countries. Our country is young and developing. If the other big old countries are facing problems like syndicated gang robberies, the economy won't be seriously affected as most (if not all) of those countries are very developed and have many well established investors.&lt;/div&gt;&lt;p&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;Whatever happened to "kenali Malaysia"? Hoping for a better air to breath in, the legal community must go back to a fraternity again.&lt;br /&gt;&lt;br /&gt;Questions have been running in my mind as to finding the answers to the actions of the bar, smelling politics all the way. The bar doesn't seem to be finding for solutions but faults. And this was channeled to the actions of the previous law minister! And the bar using the media? Bad idea! Most stories that sell are those making bombshells and exploding rumours and bad perceptions.&lt;br /&gt;&lt;br /&gt;No doubt, lawyers are too many to control but the bar should reflect noble intentions, not political, full of blame and enmity.&lt;br /&gt;&lt;br /&gt;Now the question is also that, whether the new law minister is able to supply fresh air or at least uphold the independence of judiciary. Let's hope that he is. A conclusion she had was this:&lt;br /&gt;&lt;em&gt;&lt;span style="color:#3333ff;"&gt;"Malaysia is avoiding what is a fundamental issue to its sense of nationhood and citizenship. It &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#3333ff;"&gt;must find a way to discuss race relations without the interference of political gatecrashers or rabid right-wingers.&lt;/span&gt;&lt;/em&gt;&lt;br /&gt;&lt;em&gt;&lt;span style="color:#3333ff;"&gt;It cannot sweep it under the carpet for very much longer."&lt;/span&gt;&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;&lt;div&gt;Kept me thinking, when I said:&lt;/div&gt;&lt;br /&gt;&lt;em&gt;&lt;span style="color:#3366ff;"&gt;"Talk about race, we offend too many. Indeed they have to make a choice of registering their one race when filling up forms etc. Taking sides creates major conflicts within these families and within those individuals themselves.&lt;br /&gt;&lt;br /&gt;It's no secret to what conflicts bring.&lt;br /&gt;&lt;br /&gt;So please people, start feeling and being Malaysians. Scary...</title><content type='html'>The &lt;a href="http://rockybru.blogspot.com/2008/08/permatang-pauhs-poster-war.html"&gt;Permatang Pauh's poster war&lt;/a&gt; on Rocky's Bru prompted me to think about DSAI. In the case that led us to much confusions about this person who was once our leader, he was found guilty and convicted. But finally, the Federal Court set aside his convictions and sentences. DSAI got away by technicality. The prosecution proved some but failed to prove the other elements of the charges against DSAI. And the standard of proof to find someone guilty is beyond reasonable doubt!&lt;br /&gt;&lt;br /&gt;BUT KNOW THIS! The present Chief Justice, Tun Abdul Hamid Mohamed, who wrote the judgment at that time said:&lt;br /&gt;&lt;br /&gt;"To summarize our judgment, even though reading the appeal record, &lt;strong&gt;we find evidence to confirm that the appellants were involved in homosexual activities&lt;/strong&gt; and we are more inclined to believe that the alleged incident at Tivoli Villa did happen, sometime, this court, as a court of law, may only convict the appellants if the prosecution has successfully proved the alleged offences as stated in the charges, beyond reasonable doubt, on admissible evidence and in accordance with established principles of law. ..." (Dato' Seri Anwar Ibrahim v. PP &amp;amp; Another Appeal [2004] 3 CLJ 737 at page 788)&lt;br /&gt;&lt;br /&gt;DSAI's acquittal does not mean that he did not do it.&lt;br /&gt;&lt;br /&gt;If a person is acquitted for drug trafficking, it does not mean that he is not a drug trafficker. Simpang Renggam might be his home for the next years...&lt;br /&gt;&lt;br /&gt;Another point to think about is DSAI is also openly supported by the USA as DSAI himself openly supports USA. It was the initiative of the President together with the Court of Appeal judges. It is so not cool to be personal. &lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;We are evidently human. Human assumes responsibility and it is one's skill that is relied upon by the others that creates duty. A judge is human. This is basic, PEOPLE! Surely I don't have to say more, dear LAWYERS?&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;To be fair, look at what the human can do when assuming the responsibility. The professional capacity... the exercise of knowledge... that's more like it.&lt;/div&gt;&lt;p&gt;The petition by the lawyer Haris Ibrahim obviously against the judge Tan Sri Zaki PCA is uncalled for...What's with Haris anyway, weaving political sentiments into the judiciary...? And here exists the fight for separation of powers, also by the lawyers! Perhaps Haris is so pro-Opposition and hates even the shadow sounding like A-M-N-W?&lt;/p&gt;&lt;p&gt;Yes, Tan Sri Zaki was a lawyer who did his duties as a lawyer. So were other judges like Dato' James Foong, Dato' Sulong, Dato' Gopal Sri Ram, Tan Sri Richard, and many more. But now they are judges from the day they were appointed. Haris Ibrahim would be the least to be expected not to understand this, and what he is doing seems to be politically motivated.&lt;/p&gt;&lt;div align="justify"&gt;Tan Sri Zaki evidently is dutiful President of the Court of Appeal. When he accepted responsibility as a Federal Court Judge, he really put on that robe and he became Zaki FCJ. A well known fact, he resigned from whatever other posts he was in before his appointment as a judge. &lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;p&gt;Now, he is Zaki PCA. Look at what he as the President of the Court of Appeal (PCA) has done so far!!! He is making good a job as a leader and is doing an excellent job in improvements since the beginning of 2008. And Zaki PCA is a judge, writing a number of judgments, among them the Hanif Basri case (reported widely in the media) and recently The Sun wrote on the MPK case (Majlis Perbandaran Klang). Justice is the basis of his judgments.&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;p&gt;Being so, he is contributing his efforts in dealing with backlog. Court Recording and Transcription in KL Courts started when Zaki PCA looked into it. Judges don't have to write and hearings finish faster! Minimizing the length of time for hearing, yes, yes, yes.&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;p&gt;The filing system in the Court of Appeal has been very organised, thanks to Zaki PCA. Call and ask about any file, there it is before you. The officers and staff were pushed to organize and they did it! Judges, Gopal Sri Ram JCA, Ghazali JCA, and all other JJCA support this move and even contributed to reward the officers and staff for a job well done!&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;p&gt;Go to the counter of the Court of Appeal and you will be attended to almost immediately. The cases in the Court of Appeal are now being monitored and to be immediately fixed for hearing. The lawyers and parties are being called to state their intention to proceed or discontinue. The preparation of the records are expedited.&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;p&gt;The Court of Appeal is better organised and the judges are agreeing with Zaki PCA to hear increasing number of cases in a week. The PCA said this in court, "postponement is a dirty word..."as far as the cases heard before him are concerned. And he exercises his discretion impartially. And the Chief Justice obviously seems pleased with the attitude of all judges towards applications for postponement that directives came into light.&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;p&gt;When a respondent accused person surrendered himself at the Registry of the Court of Appeal, it was considered as an urgent matter by Zaki PCA, to be fixed for hearing. The criminal appeal was fixed immediately within hours, heard the same day, and he as PCA willingly volunteered with Ahmad Maarop JCA and Sulaiman JCA and convened a coram afternoon that day. Justice is served in many ways and upholding the Federal Constitution.&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;p&gt;Come on fellow professionals and countrymen! Step back to think and look at the whole scenario in its entirety. Pinnochio...</title><content type='html'>Chaos in this country started off when the people started to pry into the private lives of those that they intend to jeopardize. Dirty politics, as they used to say. Of course is starts from attitude. The attitude of citizens of this country has got to change!!!&lt;br /&gt;&lt;br /&gt;Honesty is scarce nowadays!! Look at the revelation by one Professor Salleh Buang in the New Straits Times last Friday, 4th July 2008 at page 29 in the Letters segment. His letter entitled "Just who was behind that amendment move in 1988". And so, what the Chief Justice Tun Abdul Hamid Mohamad warned "Don't follow blindly..." in the same media on 27 June was rightly justified.&lt;br /&gt;&lt;br /&gt;Remarks and comments were passed against the past rulers of this country especially when the election started. Zaid Ibrahim purposely intended to stir this country with his move to be popular that led to the ex-gratia payment to some ex-judges. Little that the people know that those judges did indeed receive their pensions all this while.&lt;br /&gt;&lt;br /&gt;So the writer being a Professor known to be expert in some field of law rightly stated the facts to set some of them right in the eyes of the public. He wrote "who was angry enough to want that important provision amended?"&lt;br /&gt;&lt;br /&gt;It was justified to amend Article 121 of the Federal Constitution since the provision was such that it rendered an important provision of section 418A of the Criminal Procedure Code unconstitutional. A case of Public Prosecutor v Datuk Yap Peng (1987) 2 MLJ 311 was where it started and the court decided on the unconstitutionality.&lt;br /&gt;&lt;br /&gt;Therefore, all the fuss that was created by the politicians be it from the ruling parties or the opposition parties, has been baseless. And some even dare to play around with the Statutory Declarations. A mockery to the rule of law by Malaysians! And the clowns have been the lawyers in this country led by the Bar Council of Malaysia.&lt;br /&gt;&lt;br /&gt;I am really disgusted with all these lies lying around us trying to make us deviate from the very basic values. Walk the Talk will you!!!</title><content type='html'>Shortage of judges and backlog of cases have been made criticisms against the Bench i.e. Judges. The public and the Bar had caused these to be highlighted as such. Little that they realize how much the public and the Bar are also to be responsible to cause the same.&lt;br /&gt;&lt;br /&gt;The Bar particularly has been making itself popular by poking their heads into the business of others. Busybody!!! One layman's expression to describe it. Showing off the law by prying about IPCMC, Judicial Commission and logging in Kedah. Know this, the Bar cannot even control their own members and badly managed administratively and financially. But yet the Bar try to stand tall by accusing the government of poor financial management, although their stand is tainted with uncertainty.&lt;br /&gt;&lt;br /&gt;The Bar is obviously in total failure to walk the talk. Based on the reports covered by the media recently, members of the Bar do not even bother to read circulars, don't respond to requests by the Court of Appeal and yet complain about delays in court. But who causes delays?&lt;br /&gt;&lt;br /&gt;LAWYERS CONTRIBUTE TO DELAYS, definitely. If only their clients know that their own lawyers have been applying for postponements and the main cause for the delays!!! Admitting the same would take a miracle and so, put the blame on the courts. So, is it the courts or the lawyers? I invite the President of the Bar Council and the members to look at the BIG mirror first, to correct oneself before attacking others. Roger Tan, being a lawyer and a New Straits Times columnist, also being notorious of accusing everybody but the Bar Council. Therefore, little is known on the bacts that the Council is badly managed, can't even get enough quorum for their own meetings! It seems that the pointing game here highlights the JUDICIARY while there exists the right to be heard. And it seems the JUDICIARY has ones who put efforts into solving the problems and be positive about it. Objectivity and do hear this please, de facto Law Minister!&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;At last, someone is speaking on behalf of the judges! Last Friday 20 June 2008, a voice that had long been awaited which NST reported the next day: &lt;/div&gt;&lt;div align="justify"&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;"Court of Appeal President Tan Sri Zaki Tun Azmi is seeking the cooperation of the Bar Council to help reduce the backlog of cases by expediting the hearing of pending criminal and civil appeals."&lt;/span&gt;&lt;/em&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;&lt;/span&gt;&lt;/em&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;Tan Sri Zaki said, "Out of 900 pending appeals, the website only received three responses from lawyers. The Attorney-General's Chambers also responded on some of the pending appeals."&lt;/span&gt;&lt;/em&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;&lt;/span&gt;&lt;/em&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;"Towards this end, the Court of Appeal had requested the members of the Bar to respond to some questions. The President of the Court of Appeal seems to be bullish in solving the problem and therefore stressed on getting cooperation from members of the legal fraternity. He also puts the facilities to good use especially the internet and website to get speedy results.&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;As said before, when issues have been identified, the next step is to solve the problems and solve them objectively. A bonus would be having ones who can work intelligently from the manager to the staff. This issue of reducing backlog of cases must of course be a priority.&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt; &lt;/div&gt;&lt;div align="justify"&gt;Addressing problems regarding the cases by urging all parties involved to work together is wise. Pointing and telling others that they should be like this or that, or they should do this or that, is not. Get it? Too bad that he had put it in his judgment, like hiding behind the skirt of immunity as a judge.&lt;br /&gt;&lt;br /&gt;Just like what Tan Sri Azmi Kamaruddin said, Ian Chin J had his own conclusion and he may be wrong. No other judges who were there had this conclusion to make. This is serious! What's Ian Chin J's agenda? How come the de-facto Law Minister supported him right away, without jumping into a "let's form a commission" action to investigate the judge or at least the allegation?&lt;br /&gt;&lt;br /&gt;One that points straight to the de-facto Law Minister obviously is the question of him suddenly jumping into Jack Straw model of &lt;a href="http://www.judicialappointments.gov.uk/news/news.htm"&gt;Judicial Appointment Commission&lt;/a&gt; (JAC). And his efforts to rush the establishment. Well, value this... Times Online dated 29 May 2008 reported on Jack Straw and the draft Constitutional Renewal Bill that also "&lt;em&gt;proposes further reforms to the way judges are appointed&lt;/em&gt;". This includes powers of direction that "&lt;em&gt;the Lord Chancellor decides he must take the final decision [such as eligibility criteria] and consequently directs the JAC accordingly&lt;/em&gt;".&lt;br /&gt;&lt;br /&gt;Times Online further reported that "&lt;em&gt;Such powers, if introduced, would seem to run counter to the purpose of setting up the commission. The idea was to inject more transparency, objectivity and independence into the judicial appointments process — and put paid to suggestions of old-boy networks. It was to separate more clearly the roles of the executive and the judiciary — particularly at a time when the latter was being strengthened. Law Minister, in the Pointing Game are you?</title><content type='html'>Reading the newspaper, I am attracted to some statements by the minister. NST today reported "&lt;span style="color:#666666;"&gt;&lt;em&gt;Zaid said lawyers must take a serious view on such matters and only ask for adjournments for valid reasons. The courts, too, must not be seen as easily granting postponements&lt;/em&gt;.&lt;/span&gt;"&lt;br /&gt;&lt;br /&gt;Tingling of disgust came to thought. Since maybe 40 years ago postponements had been continuous issues. The courts are said to be too lenient in granting the applications for adjournment. But then the courts may have valid grounds to do so. Lawyers certainly act in the interest of their clients and some are said to find all means to get postponements. Lawyers would somehow complain against judges who may be strict in their views and decisions.&lt;br /&gt;&lt;br /&gt;The legal fraternity is one that seeks justice be done which needs all to work together. However, working together is also, "you scratch my back and I will scratch yours next time" in applications for postponement consented by the other party. Courts to be strict on this especially when the parties waive costs?&lt;br /&gt;&lt;br /&gt;&lt;div&gt;Cooperation of all in mediation, plea bargaining and pre-trial conference or criminal case management that the Minister pointed out are more in demand of a working together environment.&lt;/div&gt;&lt;div&gt; &lt;/div&gt;&lt;br /&gt;It seems Lawyers think they have a right to one or two postponement. It seems Courts have unfettered discretion at all expense. One can only hope that the appellate courts are not eager to reverse decisions on refusal of postponement. Pointing to blame? Similarly, without fear and favour in upholding justice. A judge is one who has been identified to have such quality of being just, impartial, fair and therefore chosen.&lt;br /&gt;&lt;br /&gt;Then again, a judge is also human who may err. How much a judge are Ian Chin J. and Tun Salleh Abas? How much is a judge allowed to be erroneous human? Dato' Zaid Ibrahim started off by denying ever supporting the sacking in 1988. His support or non-support has no relevance. I fail to see any wisdom in digging into the decision of sacking. It has been an insult to the qualities of the commission formed. One can easily question, what's the point of having another commission then? So much for the Commission Promoter Zaid Ibrahim.&lt;br /&gt;&lt;br /&gt;Ian Chin J. making publicity is recent, still on the grill. The judge took advantage, inserted in his judgment his opinion on what happened many years before. And the Law minister Zaid Ibrahim, said "no reason to doubt" the judge's claim, as if passing Judgment. Seemingly trying to be consistent with his statement in relation to Tun Salleh Abas too. This matter should be taken seriously, as serious allegations are made.&lt;br /&gt;&lt;br /&gt;Although mindful on the appointment and promotion of judges, Mr. Law Minister somehow fails or refuses to see the significance of the extinct quality of a judge in the judge, who took advantage making allegations in a judgment. I say quality takes precedence in appointment and promotion. The judiciary of course takes the first place at present. The revelation made by a judge displaying how fearful he was makes another point to be taken. &lt;/span&gt;&lt;a href="http://rockybru2.blogspot.com/2008/06/11-years-later.html"&gt;&lt;span style="font-size:130%;"&gt;Read this.&lt;/span&gt;&lt;/a&gt;&lt;span style="font-size:130%;"&gt; Everyone seems to be opportunist nowadays.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;One thing that puzzles me is that, the legal framework is based on the principle that &lt;strong&gt;justice is to prevail without fear or favour&lt;/strong&gt;. How are we to further acknowledge a judge or a lawyer for the very noble idea of justice when this salient value fails to exist.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;I understand Matthias Chang's point on revealing the second letter concerning an ex-judge. Any of these being transformed into positive actions? Anyone of us doing something useful other than indulging oneself into moments of self pity and depression? Surely we are not copying the other countries in a violent strike.&lt;br /&gt;&lt;br /&gt;Well, I hope someone is doing something. Maybe not so much of reversing what has been announced so far, but to soften the worries and to ease the sufferings. For the time being, one must move to adapt.&lt;br /&gt;&lt;br /&gt;My encounter on some wise men teachings include this saying, "&lt;em&gt;&lt;span style="color:#3366ff;"&gt;Identify the issues, and you can find the answers or solutions.&lt;/span&gt;&lt;/em&gt;" I believe this applies to all. And why not?&lt;br /&gt;&lt;br /&gt;Pointing fingers toward others will be resorting to a story of "&lt;strong&gt;Bangau oh Bangau&lt;/strong&gt;". As the snake finally says, "&lt;strong&gt;memang makanan aku&lt;/strong&gt;", perhaps that is the reason for "&lt;strong&gt;katak bawah tempurung&lt;/strong&gt;" and we know what that means. But we must face the world, don't we? The point made was the politician being obsessed about getting even or rather putting someone down by attack of personality, character and possibly on privacy. Where is he going exactly? It's not about the country, it's not about the people, not about accomplishment or delivery, and definitely not about moving forward toward harmonious developed nation. Vengeance, isn't that a dangerous thing? Obviously selfish in political arena; not wise.&lt;br /&gt;&lt;br /&gt;&lt;p&gt;Listen to the cries of the people to find ways in consolation. A word that came to my mind when I saw the heading. "&lt;strong&gt;&lt;a href="http://thestar.com.my/news/story.asp?file=/2008/6/5/nation/21446353&amp;amp;sec=nation"&gt;PAS the real kingmaker in M'sian politics&lt;/a&gt;&lt;/strong&gt;" by Fui K. Soong. This article at page N30 VIEWS in The Star dated Thursday 5 June 2008 got my pair of sight stuck to it. I am no politician but I do believe in democracy and it is about listening to what the voters have to say.&lt;br /&gt;&lt;br /&gt;This article is not without a CV that goes with it. A CEO of Institute of Strategic Analysis and Policy Research, "&lt;em&gt;to research on the removal of barriers and bias in policies that impede Malaysia unity, racial harmony and economic prosperity&lt;/em&gt;". The writer covers the current situation as "&lt;em&gt;The contest for the Malay space&lt;/em&gt;" and further stated that it "&lt;em&gt;is heating up and is about to get hotter.&lt;/em&gt;"&lt;br /&gt;&lt;br /&gt;On commenting the meeting of the Malay writers and intellectual group called Gapena in Johor in May, the writer puts "&lt;em&gt;what is important to note is that Malay-based interest groups have been all out to woo the hearts and minds of the Malay constituents.&lt;/em&gt;"&lt;br /&gt;&lt;br /&gt;Now this is something that one must identify as issues to get some hands on. Surely this article is based on research. It arrives at a conclusion that "&lt;em&gt;PAS is the most well organised, most financially independent an dmost talented party in Malaysia right now.&lt;/em&gt;" Somehow, the writer's somewhat suggestion or rather forecast that instead of coming into UMNO, PAS would consider being a part of BN. Reasons:&lt;br /&gt;1. Safest way to sustain the party&lt;br /&gt;2. To fulfill all or part of their ambitions&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;What are their ambitions?&lt;br /&gt;1. Good federal-state relations&lt;br /&gt;2. For unity&lt;br /&gt;3. To set the focus right for the future&lt;br /&gt;4. Sustainability of the party&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The writer further said, "&lt;em&gt;it seems the new political game has barely even begun for Malaysia&lt;/em&gt;". Oil price hike! So must the electricity tariff! The people's hope for a change, materialized at last! BUT this change has shattered dreams going with it. Desperation in seeking for relief will be seen. Depression, a result on many.&lt;br /&gt;&lt;br /&gt;This makes me curious. I am now thinking of indulging myself in the study of economy. But we already have professionals in that area. Come on specialists, I am sure there is something creative that we can do to be in control of the situation. Come and say your piece...PLEASE&lt;br /&gt;&lt;br /&gt;Being creative will certainly be appealing for many. In survival, it is an art. On the other hand, appalling to some. The creativity may then hunted being labelled as a crime. Think people! Pressing the citizens economically? Bright idea, isn't it.&lt;br /&gt;&lt;br /&gt;Petty crimes will definitely increase. I remember reading the news some time ago, a desperate father to a toddler stole a packet of Nestum for his son because he can't afford it and his son was crying of hunger. Then, a solebreadwinner mother of two working as a cleaner took some spoiled and almost rotten fish, caught and labelled as a thief. Her earnings must be only around RM500.&lt;br /&gt;&lt;br /&gt;Creative people will find some ways out in survival, be it along the law, around the law or against the law. We already have babies on sale, so no great surprise on more new ideas. In survival, this art will be top of the list. So, BE WARY. When our politicians cannot come to terms? All they do is find faults. Why don't they just identify the issues and problems, and think of solutions! After all, they have been chosen by the people. So live with it and deliver.&lt;br /&gt;Clearing the air between our political figures is useless as far as the people is concerned. Unless they genuinely work for the nation, I don't see any reason why they should hold any position in our politics. Of course being an ordinary human being, one cannot escape from the worldly desires and life sustainment. However, the ultimate purpose must assume priority amongst all.&lt;br /&gt;Praise to all our "pahlawan" who fought genuinely for our country and some died defending her. Nevertheless I pity their efforts then which now being wasted by our own countrymen. Sadly, it's being sacrificed in pursuit of wealth. Malaysia Oh Tanah Air ku... We need a savior, or rather saviors. Anyone or everyone can be savior. Does it matter who the person is, or whether one is a person with a title before the name? Of course not. Personality is not an issue here. Anyone can be leaders as long as the qualities are imminent; be it Pak Lah, Najib, Anwar, Muhyiddin, Che Det, etc.&lt;br /&gt;&lt;br /&gt;A person suddenly shows up with performance can be our leader, one who has the drive and ability to push the country on top of others in terms of unity, economic strength and prosperity, and strategic security i.e. the good of the people.&lt;br /&gt;&lt;br /&gt;Somehow, I have faith to the emergence of savior. Of course one can hardly see any, too engrossed with hatred and vengeance. Proper focus is what we need. The government is weak enough as it is. At least address the deserving issues at hand. All we hear after that was numbers after numbers being shown. We read stories about cases being dragged for years without an end. We hear about the courts.&lt;br /&gt;&lt;p&gt;Going back to what RPK said about the Court of Public Opinion, ordinarily, it is normal that public opinion rests on what they hear and see. What they hear and see is usually what they get from the news and news are usually selective. Proof, will be looked at later, if ever. &lt;/p&gt;&lt;p&gt;Look at comments on trials, allegations, gossips, etc. What matters now? Check them out.&lt;/p&gt;&lt;p&gt;Quoting JUDGING THE RECORDING SYSTEM&lt;/p&gt;&lt;p&gt;&lt;span style="font-size:78%;"&gt;"In January last year, the Government had handed the management of the e-court system – covering case management, court recording and transcription (CRT) and an information technology infrastructure – to former Chief Justice Tun Ahmad Fairuz Sheikh Abdul Halim. But very little has been heard since then of the e-court pilot.&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style="font-size:78%;"&gt;This January, new Chief Justice Datuk Seri Abdul Hamid Mohamed tasked new Court of Appeal President Justice Tan Sri Zaki Tun Azmi and new Chief Judge of Malaya Justice Datuk Alauddin Mohd Sheriff with the job of shaping up the administration of the courts in the peninsular.&lt;br /&gt;Their primary target is to reduce complaints about missing court files, poor counter service, long waits for trial/appeal dates, long trials and even longer waits for grounds of judgment.&lt;/span&gt;&lt;/p&gt;&lt;span style="font-size:78%;"&gt;Their primary target is to reduce complaints about missing court files, poor counter service, long waits for trial/appeal dates, long trials and even longer waits for grounds of judgment.&lt;br /&gt;Justice Abdul Hamid approved a pilot project for a recording and real-time transcription service in two courtrooms in the Jalan Duta Court Complex and directed Justice Zaki to report on the viability of the new and existing systems.&lt;br /&gt;When the second largest court complex in the world opened on May 3, 2007, it was equipped with two court recording and transcription (CRT) systems – an analogue recording system in 65 courtrooms and a digital recording system in nine courts. Unfortunately, they were not widely used, say High Court Justices Datuk T.S. Nathan and Datuk Ramly Ali.&lt;br /&gt;However, with the CJ’s interest in utilising CRT to speed up commercial and civil hearings coupled with Justice Zaki’s drive, things are moving again.&lt;br /&gt;According to Justices Nathan and Ramly, the digital recording systems work the best.&lt;br /&gt;“There is a consensus that we abandon the analogue system because it is too unwieldy and problematic,” says Justice Nathan.&lt;br /&gt;Not one to mince his words, Justice Zaki apparently told the recent Conference of Judges that the “analogue system should be thrown out the window”.&lt;br /&gt;Bar Council secretary Lim Chee Wee suggests it be sold as scrap so the taxpayers’ money is not wasted.&lt;br /&gt;As for the digital system, one provides delayed transcription, the second offers almost real-time transcription, says Justice Ramly.&lt;br /&gt;The ideal in real-time transcription is for the judge and counsel to see the words on their (individual) screen as they are typed. Also, in high profile public interest cases, recordings of the day’s proceedings can be burnt onto CDs and given to judge and counsel, along with a transcript, so they can check for errors and corrections can be made the very next day.&lt;br /&gt;Judges who use the digital CRT system are optimistic it can reduce the length of trials and long waits for trial dates."&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:78%;"&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;Quoting ZAKI MAKES SENSE OF CHAOS IN FILING ROOM&lt;br /&gt;&lt;span style="font-size:78%;"&gt;"A SMART partnership is one where all members have the same vision but they draw on each other's strengths to up their game.&lt;br /&gt;Focussing on policy matters, Chief Justice Datuk Seri Abdul Hamid Mohamed, who took over as top judge on Nov 1, has delegated the nuts and bolts of administration to Court of Appeal president Tan Sri Zaki Tun Azmi.&lt;br /&gt;When the Court of Appeal first moved to Putrajaya, the filing room was in a chaotic state, says a senior judge who spoke on grounds of anonymity.&lt;br /&gt;...&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:78%;"&gt;Within two and half months of becoming President, Justice Zaki worked with his registry staff to sort out the mess. Credit should also go to the staff who slaved on the project, working after hours and giving up their weekends, says the judge.&lt;br /&gt;...&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:78%;"&gt;It is learnt that while chaos reigned with 13 filing clerks, peace reigns today with only two clerks manning the system. As a result, the government has saved some RM200,000 in employing new staff because the 11 clerks have now been deployed to more gainful work.&lt;br /&gt;Justice Zaki has also encouraged urgent applications to be treated as appeals proper, to speedily dispose off matters generally, and interlocutory matters especially.&lt;br /&gt;...&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:78%;"&gt;There is a rule that allows for this approach to be employed with regard to urgent appeals but no previous CJ or President had allowed judges to use that rule.&lt;br /&gt;Contrast that to last week in the Court of Appeal where most of the applications were for extension of time to file the appeal record. Many of these cases concerned interlocutory applications that the High Court had either denied or allowed, for example, summary judgment applications, applications to amend the pleadings or a stay of proceedings in the High Court.&lt;br /&gt;The panel under the chairmanship of Justice Sri Ram converted many of these applications to proper appeals so that the trial of the action need not be delayed.&lt;br /&gt;“The court could do this because the President encourages such measures,” says the judge.&lt;br /&gt;While Lim says Justice Zaki's attempt to shake up the registry is a positive move, the judge adds wryly: “Justice Zaki is very unpopular with the indolent. The hardworking get along well with him.”&lt;br /&gt;The other areas in which Justice Zaki has brought timely change to are:&lt;br /&gt;&gt;DISPOSAL of leave applications – taking off from Justice Abdul Malek's leave applications committee (which would only fix a hearing date if it first rejected leave) that cleared 1,700 applications in six months from a backlog of 2,000 in 2004, he has directed that all such applications be disposed off in weeks;&lt;br /&gt;&gt;PENDING criminal appeals – getting lawyers and the Attorney General's Chambers to indicate in a form online whether the appeal is against conviction and sentence or sentence alone so he can prioritise them because the latter takes shorter time to hear; and&lt;br /&gt;&gt;ENCOURAGING judges to deliver extempore (off the cuff) decisions – he made available a digital CRT system available for use in one Court of Appeal courtroom on April 21. One of the discussions was to leave the decision to the members of the public. He is saying that, the only court that matters is the so-called Court of Public Opinion (COPO) and wrote:&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:85%;"&gt;"But there are opinions and there are opinions -- and, just like assholes, no two are alike. So, while we value the expert opinions of our ‘learned’ legal eagles (yes, that is what they call each other in court even though they may be arguing -- how civil), we too have conducted our own trial by court of public opinion and we have already arrived at our verdict even while the Altantuya murder trial is halfway through and long before we can see the end of what many consider a show-trial in a kangaroo court."&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;Public opinion supplements the making of the law of the land. The writer in the first place preaches freedom and then the right of the people. The judiciary is a medium to set things right by certain appointed people of certain intelligence and stature. It is seen to represent the people in certain ways in the name of justice.&lt;br /&gt;&lt;br /&gt;Public opinion in the ordinary sways from the relevant point altogether. Allegations and accusation are obviously being delivered as an end to the gather of public opinion. This departs from the recognized principles. First would be, A PERSON IS INNOCENT UNTIL PROVEN GUILTY. Then comes this, that there is always the RIGHT TO BE HEARD.&lt;br /&gt;&lt;br /&gt;Of course FREEDOM OF EXPRESSION has a part in this.
